Domestic partnerships are not a good enough substitute for marriage, the justices ruled 4-3 in striking down the ban.

Outside the courthouse, gay marriage supporters cried and cheered as the news spread.

Jeanie Rizzo, one of the plaintiffs, called Pali Cooper, her partner of 19 years, and asked, "Pali, will you marry me?"

"This is a very historic day. This is just such freedom for us," Rizzo said. "This is a message that says all of us are entitled to human dignity."

In the Castro, historically a center of the gay community in San Francisco, Tim Oviatt started crying while watching the news on TV.

"I've been waiting for this all my life," he said. "This is a life-affirming moment."

The city of San Francisco, two dozen gay and lesbian couples and gay rights groups sued in March 2004 after the court halted the monthlong wedding march that took place when Mayor Gavin Newsom opened the doors of City Hall to same-sex marriages.

"Today the California Supreme Court took a giant leap to ensure that everybody — not just in the state of California, but throughout the country — will have equal treatment under the law," said City Attorney Dennis Herrera, who argued the case for San Francisco.

The challenge for gay rights advocates, however, is not over.

A coalition of religious and social conservative groups is attempting to put a measure on the November ballot that would enshrine laws banning gay marriage in the state constitution.

The Secretary of State is expected to rule by the end of June whether the sponsors gathered enough signatures to qualify the marriage amendment, similar to ones enacted in 26 other states.

If voters pass the measure in November, it would trump the court's decision.

California already offers same-sex couples who register as domestic partners the same legal rights and responsibilities as married spouses, including the right to divorce and to sue for child support.

But, "Our state now recognizes that an individual's capacity to establish a loving and long-term committed relationship with another person and responsibly to care for and raise children does not depend upon the individual's sexual orientation," Chief Justice Ron George wrote for the court's majority, which also included Justices Joyce Kennard, Kathryn Werdegar and Carlos Moreno.

In a dissenting opinion, Justice Marvin Baxter agreed with many arguments of the majority but said the court overstepped its authority. Changes to marriage laws should be decided by the voters, Baxter wrote. Justices Ming Chin and Carol Corrigan also dissented.

The conservative Alliance Defense Fund says it plans to ask the justices for a stay of their decision until after the fall election, said Glen Lavey, senior counsel for the group.

Gov. Arnold Schwarzenegger, who has twice vetoed legislation that would've granted marriage rights to same-sex couples, said in a news release that he respected the court's decision and "will not support an amendment to the constitution that would overturn this state Supreme Court ruling."

The last time California voters were asked to express their views on gay marriage at the ballot box was in 2000, the year after the Legislature enacted the first of a series of laws awarding spousal rights to domestic partners.

Proposition 22, which strengthened the state's 1978 one-man, one-woman marriage law with the words "Only marriage between a man and a woman is valid or recognized in California," passed with 61 percent of the vote.

The Supreme Court struck down both statutes with its sweeping opinion Thursday.

Lawyers for the gay couples had asked the court to overturn the laws as an unconstitutional civil rights violation that domestic partnerships cannot repair. A trial court judge in San Francisco agreed with gay rights advocates and voided the state's marriage laws in April 2005. A midlevel appeals court overturned his decision in October 2006.

NOTE: i am posting this in general discussion because it is a NEWS event that can be discussed generally. i did not post it in Politics & Religion within the "Gay Rights" thread because that is whether people believe gay right should or should not be allowed (and also seems to stray to what causes hpmosexuality). i feel this case is monumental, especially considering Governor Schwarzenegger's prior vetoes.

This has never been an issue here.
There arent anything such as marriage here. Insted, there a law allowing people to live with all the benefits as if they were married.

That little artical on the first page seems to be leaving out the fact that 60% of California's population voted against gay marriage, the justices did what they wanted to do, not what the majority of California wanted to do. This is not how it should be.

you're an idiot. did you CHECK the year that the 61% vote for PROPOSITION 22 took place? in 2000, 8 years ago. i can almost entirely assure you that this time around, it will pass.

the supreme court of CA did not veto that.


and it is UNCONSTITUTIONAL TO BAN GAY MARRIAGE - we live in a SECULAR country where religion doesn't dictate marriage. homosexuals are ALSO people - and if they want to get married, it is OBVIOUSLY not simply about sex.

my aunt has a life partner. they got married in san francisco - but it was annulled thanks to arnold. now, they don't harm any straight people by being together, and have been together for at least 13 years now (while my own parents got divorced when i was 2). i do not see where you think it's ok that these people do not receive the SAME RIGHTS as any straight person. HELL, straight people get drunkenly married in vegas daily, and no one bothers making that illegal despite the obvious idiocy behind it.

by the way, did you know the california state supreme court consists of 6 republicans and 1 democrat? that means the 4-3 vote consisted of a split in the republicans - showing they too believe in this change.

WTF? This is twisted thinking. Sad that so many people can't think outside that box. OK, this is about a broader concept than just gay marriage. This is about freedom.

Why does it matter what a majority thinks when it comes to right and wrong? Large majorities across the U.S., over 80%, once supported the ban on interracial marriages. Hitler was voted in by and broadly supported by huge majorities in Germany. The majorities then were just as wrong then as the racist minority is now. Reality doesn't change based on a lot of people agreeing on something. I don't care if a kajillion people and aliens across the entire universe vote, they shouldn't have any say so in my personal decisions that don't harm them. I don't care if the universe votes to enslave me. we each as individuals have a right to our own decisions and our own lives. Majorities can simply be wrong, and when they are, individuals should defy them. The truth is the truth and this is a case where humanity managed to get a little bit closer to the truth, despite its fumblings and failures and bizarre attempts at finding morality through silly ideas like democracy and constitutions written on hemp paper.

This is really sad to me. Why? Because this person has so much of their personal dignity tied up in approval from the State. I believe all of us should respect the decisions of others in their own lives and stop trying to control people, and in that respect this seems like a good decision to me because it at least rings of equality. Still, I don't care what the State says. I won't get a State marriage to anyone because I don't need their approval to feel good about myself and my own choices. If I have a relationship with someone, anyone, male or female, no one's opinion matters outside of mine and the other person in that relationship. The effing government should just butt out.

it's not the approval of the state - it's the fact that the state finally recognizes the legality of making marriage "equal" to all.

it's not about approval -it's proof that their movement finally has been affirmed.




in the case of racial segregation of "separate but equal" many years ago, it was considered ok to have separate premises for blacks that were "equal" (but not really) to their white counterparts. this was essentially how "civil unions" were for homosexuals - a marriage that wasn't actually marriage.
it's not about getting the state to affirm to themselves that they can get married, but it's about proving to all that they truly & rightfully deserve to have a regular marriage that any straight couple would.

and where do you get marriage licenses? the state.
